1.2 Nothing in the User Terms limits or excludes either party’s liability for:

• 1.2.1 death or personal injury caused by its negligence;
• 1.2.2 fraud or fraudulent misrepresentation; or
• 1.2.3 any other liability which cannot be excluded or limited under applicable law
